Since the Bestellerprinzip in Vienna (1 July 2023): whoever commissions the broker pays the broker. For classic renting via willhaben or ImmoScout24 with tenant search, this means in practice: as the landlord you bear the commission (max. 3 gross monthly rents + 20% VAT) – not the tenant any more. Sounds unpleasant, but is usually cheaper than expected: in return you get a marketed rent value that is often €80–150/month above the self-listing price, vetted credit and a legally watertight tenancy contract.
When does the tenant still pay? When the tenant actively commissions me with the apartment search – that's my second activity (search mandates for tenant prospects). We clarify before every marketing in writing which constellation applies to you.
